Wizara ya Mambo ya Nje na Wahamiaji palestina, inalaani vikali hatua za mamlaka ya ukaliaji wa mabavu ya Israel, kuvamia makao makuu ya Shirika la Umoja wa Mataifa la Kuhudumia Wakimbizi wa Kipalestina (UNRWA) katika mtaa wa Sheikh Jarrah, uliopo Jerusalem inayokaliwa kwa mabavu. Mamlaka hizo za ukaliaji zilifanya ubomoaji, kupora mali za Shirika hilo, na kupandisha bendera ya nchi inayokalia eneo hilo kimabavu juu ya majengo hayo, jambo ambalo ni ukiukaji wa wazi wa sheria za kimataifa na kinga ya vifaa vya Umoja wa Mataifa.
Wizara inathibitisha kuwa shambulio hili ni ukiukaji mkubwa wa kanuni na misingi yote ya sheria za kimataifa, na ni ukiukaji wa wazi wa wajibu wa Israel, kama nchi inayokalia eneo husika, chini ya Mkataba wa Nne wa Geneva; hasa ule unaohusu ulinzi wa mali za umma na kuhakikisha mashirika ya kimataifa ya kibinadamu yanafanya kazi bila kizuizi. Aidha, hatua hiyo inakiuka Mkataba wa Kinga na Maridhiano ya Umoja wa Mataifa wa mwaka 1946.
Wizara inasisitiza kuwa sheria au maamuzi yoyote yanayotolewa na mamlaka hizo za ukaliaji wa mabavu hayana nguvu yoyote ya kisheria juu ya hadhi ya UNRWA, uwepo wake, au shughuli zake katika ardhi ya Palestina inayokaliwa kwa mabavu, ikiwemo Jerusalem Mashariki, ambayo ni sehemu muhimu ya ardhi hiyo chini ya sheria za kimataifa na maazimio husika ya Umoja wa Mataifa.
Wizara inaonya juu ya uzito wa ongezeko hili la makusudi la chuki dhidi ya UNRWA, ambalo linakuja ndani ya mfumo wa mkakati wa kimfumo wa kulenga dhima na mamlaka ya Umoja wa Mataifa, na jaribio la kuvuruga mfumo wa ulinzi wa kimataifa kwa wakimbizi wa Kipalestina na haki zao zisizoweza kupokonywa, hususan haki ya kurejea.
Wizara inaitwika Israel dhima nzima ya shambulio hili na kuuomba Umoja wa Mataifa na nchi wanachama wake, hasa wafadhili wa UNRWA, kuchukua hatua za dharura kusitisha ukiukaji huu na kulinda kazi za Shirika hilo. Wizara pia inathibitisha kuwa itaendeleza juhudi za kidiplomasia na kisheria ili kuifanya nchi hiyo inayokalia ardhi kwa mabavu iwajibike kwa ukiukaji wake mkubwa na endelevu wa sheria za kimataifa, na kulinda uwepo wa Umoja wa Mataifa katika ardhi ya Palestina inayokaliwa kwa mabavu.

Ministry of Foreign Affairs Holds Israel Responsible for the Storming and Demolition of UNRWA Facilities in Jerusalem
The Ministry of Foreign Affairs and Expatriates strongly condemns the storming by the Israeli occupation authorities, on Tuesday, of the headquarters of the United Nations Relief and Works Agency for Palestine Refugees (UNRWA) in the Sheikh Jarrah neighborhood of occupied Jerusalem. The occupation authorities carried out demolition works, seized the Agency’s property, and raised the flag of the occupying power over the premises, in a blatant violation of international law and the inviolability of United Nations facilities.
The Ministry affirms that this attack constitutes a serious breach of all rules and norms of international law, and a clear violation of Israel’s obligations, as the occupying power, under the Fourth Geneva Convention, particularly those related to the protection of public property and ensuring the unhindered operation of international humanitarian organizations. It also violates the Convention on the Privileges and Immunities of the United Nations of 1946.
The Ministry stresses that any legislation or decisions issued by the occupation authorities have no legal effect on the legal status of UNRWA or on its presence and activities in the occupied Palestinian territory, including East Jerusalem, which constitutes an integral part of the occupied territory under international law and relevant United Nations resolutions.
The Ministry warns of the gravity of this deliberate escalation against UNRWA, which comes within the framework of a systematic targeting of its role and UN mandate, and an attempt to undermine the international protection system for Palestinian refugees and their inalienable rights, foremost among them the right of return.
The Ministry holds Israel fully responsible for this attack and calls on the United Nations and its member states, especially supporters of UNRWA, to take urgent action to halt these violations and protect the Agency’s work. The Ministry also affirms it will continue diplomatic and legal efforts to hold the occupying state accountable for its grave and ongoing violations of international law, and to protect the presence of the United Nations in the occupied Palestinian territory.
